What Federal Contractors Should Know About Employment Practices and Compliance Risk

Federal contractors face added compliance considerations when employment practices intersect with the representations and certifications they make to the federal government.
Engage PEO Associate General Counsel and Director of HR Services Robert Dominguez discussed this issue with Bloomberg Law in connection with a $22 million settlement involving allegations that a federal contractor’s diversity-related employment practices violated federal contracting requirements.
Dominguez highlighted the practical considerations companies face when deciding whether to challenge government allegations. Defending a case against the federal government can involve years of litigation and significant legal expense. As a result, a settlement may reflect a business decision to limit cost, disruption and uncertainty rather than a determination that the company violated the law.
