Summer Interns: To pay or not to pay. What are the rules?

Some experts are predicting an increase in more traditional unpaid internships this year. This is likely due to the Department of Labor's new test for determining whether interns qualify as employees under the Fair Labor Standards Act (FLSA).  If an intern does qualify as an employee, he or she must be paid at least minimum wage as well as overtime.

Companies today understand that for a business looking to stay competitive while attracting top talent, incorporating an internship program can create a never-ending stream of future full-time employees. Recent statistics indicate that the majority of large companies (those with more than 100 employees) hire interns to find potential future employees, while smaller companies (usually those with less than 50 employees) hire interns for the purpose of acquiring part-time help on projects.
