Home Health Care Employers: About the 8/80 Rule for OT

The unique staffing needs of residential care facilities means that the number of hours an employee works per week can quickly exceed legal maximums when calculating overtime.

The Fair Labor Standards Act (FLSA) recognizes these unique challenges and includes an alternative method for residential health care employers to calculate overtime hours, commonly referred to as “8/80 rule.”
